That distinction is not bureaucratic neatness. It decides whether authorities can prove protection worked, or only count the losses months later.
Spain offers a more concrete route from warning to obligation. AEMET alerts identify territorial danger, while MoMo mortality monitoring estimates excess deaths by comparing observed deaths with expected deaths. Since 2023, Spain has also required outdoor work to be adapted, and potentially stopped, when dangerous weather makes protection impossible under the BOE measure.
That matters because labour is where heat stops being an environmental warning and becomes a power question. A worker can receive an alert and still face pressure to continue. The law gives warnings a path into workplace decisions, but enforcement still depends on employers, inspectors and local practice.
Italy and Germany show the same accountability gap in different ways. Italy’s Health Ministry runs a heat-bulletin system for 27 cities, while INAIL and INPS connect heat to workplace risk and income support. Germany’s DWD warnings, RKI mortality analysis and UBA heat-action guidance make the risk visible, but the harder evidence remains scattered: where work stopped, which schools adapted, and which hospitals overheated.
Europe Can Help, But Cannot Command
At EU level, the limit is plain. Copernicus can track conditions, Copernicus EMS can support emergency awareness, Climate-ADAPT can share practice, and the Civil Protection Mechanism can coordinate help when countries are overwhelmed. But power over health protection and civil protection still sits mainly with national and local authorities, as Article 168 TFEU and Article 196 TFEU make clear.
Climate change raised the odds of this kind of danger, but this specific event still needs careful attribution. The IPCC says human-caused warming has made hot extremes more frequent and intense across most land regions, including Europe, while World Weather Attribution sets out how rapid event studies test individual episodes.
Europe’s benchmark is grim. The summer of 2022 brought an estimated 61,672 heat-related deaths in Europe, despite modern forecasting and warning systems, according to Nature Medicine. Meteorologists saw this heat coming; authorities now carry the burden of showing what changed on the ground before the mortality statistics arrive.
