A theoretical protocol offers the only protection for the civilian berths of Constanta.

Romania controls its airspace and territorial waters. When a slow, cheap drone drifts towards a civilian berth, the decision to evacuate workers or close a terminal rests with Romanian authorities, not with allied command structures.
That decision depends on warning time. The figures show how routine the threat has become. Since Russia's full-scale invasion began, Romania's defence ministry has counted more than 100 attacks near the border, 29 unlawful Russian drone entries into Romanian airspace, and 15 airspace violations in 2026 alone requiring 26 military-police scrambles (Agerpres).
Romania has asked allies for low-altitude radars and interceptor drones to deal with small, slow objects that conventional air defence was not designed to stop (Straits Times). It has also ordered 24 German Skyranger 35 counter-drone systems (ArmyRecognition). But procurement works in years, not weeks. A bilateral protocol with Kyiv could fill part of that gap faster, provided it is more than a political promise.
A Protocol Nobody Can Read
No signed text has been made public. DW Romania reported that after earlier drone incidents in Galați and Constanta, authorities promised explanations "in a matter of days." What the public received instead was a list of unanswered questions.
A serious protocol would have to settle basic points that have not been publicly addressed. How many minutes does Ukraine have to notify Romania after losing contact with a drone? Where exactly must self-detonation happen? Who receives the warning: the navy, the port authority, the border police? And if debris from a pre-border detonation still damages a ship or forces a port closure, who pays?
Lithuania has taken a cleaner route. On 30 June, its parliament passed a law giving civilians harmed when Lithuanian or allied forces lawfully shoot down a drone the right to claim compensation from defence funds, with a three-year filing window (LRT). Vilnius identified the liability gap, wrote it into law, and published the mechanism.
Romania's protocol remains invisible to the port workers, shipping companies and coastal residents who would carry the cost if it fails. The same improvisation is visible along NATO's eastern edge, with Latvia and Finland building separate counter-drone systems and liability rules without a shared template (Euronews, Yle).
Romania's interim defence minister Radu Miruta has said responsibility lies with those who launch the drones. That line preserves solidarity with Ukraine while refusing to treat routine spillover as normal. But a principle is not a claims procedure. Romania has described a safety plan more clearly than it has shown one. Until the protocol's terms are public, Constanta's port workers and shipping companies are being asked to trust a mechanism they cannot read.
